Iraq Tax Clearance Certificates for Contractors and Tender Bidders
A tax clearance certificate is a gate: government tenders, contract awards, licence renewals and, in practice, many payment releases wait on it. The certificate is not a form to be requested and collected. It is the visible output of a clean tax file, and it is only as good as the filings, deposits and reconciliations behind it.
What the Commission actually reviews
Before issuing clearance the Commission looks at whether returns have been filed for the periods the entity was active, whether assessments have been settled or formally disputed, whether withholding deposits have been made and correctly attributed, and whether the registration details match the company's current legal status.
A file can be financially current and still fail on a technical point: a name change not reflected in the registration, a duplicate taxpayer number opened by a branch, or deposits recorded against the wrong entity. We run those checks before submitting, because a rejected request restarts the queue.
Closing the gaps that block issuance
Where returns are outstanding, they are prepared and filed for each open period rather than consolidated into one. Where an assessment is disputed, the objection is documented so the file shows a live dispute rather than an unpaid debt. Where arrears exist, settlement and any available instalment arrangement are formalised with the Commission.
For groups, clearance is usually needed entity by entity. We map which legal entity holds the contracts, which holds the licence and which holds the payroll, and clear each file rather than assuming a parent-level settlement covers a subsidiary.
Keeping clearance valid through a project
Certificates are issued against a point in time. A long project will generate new withholding obligations, new payroll periods and new subcontracts, each of which can put the file back out of order. We maintain the calendar so renewal does not become an emergency, and so a mid-project audit does not discover an unfiled period.
Questions we are asked
How long does clearance take?
It depends on the state of the file. A current file with clean deposits moves through review; a file with unfiled periods, mismatched deposits or an unsettled assessment needs those issues resolved first, and that work, not the request itself, determines the timeline.
Can clearance be obtained while an assessment is under objection?
It can be possible where the dispute is properly documented and the undisputed portion is settled, but the Commission's position is decided case by case, and we confirm the approach with the file officer before submitting.
Does a clearance certificate cover subcontractors?
No. Each taxpayer has its own file and its own certificate. Main contractors that rely on a subcontractor's certificate should verify it covers the correct entity and period.
