Iraq Payroll, Personal Income Tax and Social Security Compliance
Payroll is the highest-frequency tax obligation most employers have in Iraq, and the one with the least tolerance for improvisation. Every pay period produces a withholding position, a Social Security position and a document trail that an inspector can test employee by employee.
Personal income tax on employment income
Personal income tax is charged under Income Tax Law No. 113 of 1982, which applies a graduated schedule to individuals, with the employer responsible for withholding from salaries and remitting the deducted amounts. The practical questions are which allowances form part of taxable income, how benefits in kind are valued, and how residency affects the treatment of an expatriate's salary.
Because there is no comprehensive double taxation treaty network covering every Iraq-related employment structure, the residency and sourcing analysis matters for both the employee and the employer's withholding position. We document that analysis per employee rather than applying a blanket assumption to the payroll.
Social Security registration and contributions
Employers register with the Social Security administration and contribute under Social Security Instructions No. 1 of 2007, which set out employer and employee contribution obligations, registration requirements and payroll withholding procedures. Contribution files are tested against the payroll register, so the headcount reported, the salaries declared and the amounts paid have to agree.
Common failures are straightforward and avoidable: employees added late, salaries declared below the actual payroll, and contribution periods missed during a restructuring. Each is visible on inspection and each is corrected more cheaply before it is found than after.
End-of-service, severance and leavers
Termination payments, accrued leave and end-of-service benefits each raise a withholding and contribution question. We build the leaver calculation into the payroll close so the payments are treated consistently and the file records the basis used, which matters if the employee later disputes the settlement.
Questions we are asked
Are expatriate employees taxed on their full salary in Iraq?
It depends on residency and on where the employment is performed. Days worked in Iraq, the location of the employer and the terms of the contract all affect the position, so the analysis is done per employee and documented in the payroll file.
Do allowances form part of taxable payroll?
Several allowances are treated as part of employment income unless a specific exemption applies. The payroll setup should record each allowance separately with the authority relied on, rather than aggregating them into basic salary.
What happens if Social Security contributions were underpaid in earlier years?
The file is reconstructed for the affected periods, the shortfall is quantified and regularised with the administration, and the payroll process is corrected so the same gap does not recur.
